Third Party Cases

When you have a personal injury case in addition to a worker’s compensation claim it is called a third party case.  A third party case arises when you are injured by a third party while performing work for your employer.  For instance, a commercial truck driver may be rear ended by a private citizen while making a delivery.  If the truck driver is injured in the crash, he would not only have a worker’s compensation claim against the company that he was working for, but he would also have a personal injury claim against the person that rear ended him.

In third party cases, insurance companies have the right to subrogate against the party at fault.  This means that the insurance company has the right to recover what is paid out on the worker’s compensation claim.  For instance, if you filed a third party claim against a company and received $300,000, but $100,000 of that amount was for compensation and medical benefits, you would have to pay the insurance company $100,000 and your gross recovery would be $200,000.  It is possible for the amount the insurance company receives to be reduced depending on whether the insurance company participated in the litigation.
